General Terms and Conditions

This is a translation for your convenience. The German version is legally binding.

1. Scope and provider

These General Terms and Conditions (Terms) apply to all contracts for the use of the A² app and online coaching from A-Squared (A² Coaching), sole proprietorship, owner Alexander Hafner, Alte Landstrasse 2, 8302 Kloten, Switzerland (“we”). Deviating terms of the client do not apply.

2. Services

We provide you with the A² app and support you as an online coach: individual training plan, nutrition targets, evaluation of your check-ins, feedback and messages in the app chat. The exact scope follows from the description in the app at the time of purchase.

The app is in a beta phase. Features may change, be added or removed, and interruptions or errors may occur. We aim for high availability but do not guarantee it.

We owe careful support, but not a specific result (e.g. weight loss, muscle gain). Results depend largely on your implementation, health and other factors.

Some features use artificial intelligence, e.g. for drafts of training plans and feedback or nutrition estimates from photos. Plans and feedback are reviewed by the coach before you see them. Nutrition estimates are shown directly and are estimates that may be wrong.

3. Conclusion of contract and requirements

The contract is concluded when you start the subscription in the app and payment succeeds. You must be at least 18 years old, have full legal capacity and have accepted these Terms and the privacy policy.

4. Prices and payment

The price shown to you in the app before purchase applies (12-week program CHF 690 one-time or 3 monthly instalments of CHF 249; continued coaching after a program CHF 149 per month, unless agreed otherwise in an individual case). We are not registered for VAT; no VAT is charged.

Free beta: beta testers may use the app free of charge for an agreed period (usually 8 weeks). In return they do the weekly check-in, give short feedback at the end and provide a testimonial with their first name, which we may publish with their separate consent. Before/after photos are optional. Consent to publication can be revoked at any time; we then remove published posts within 30 days. After the free period access ends automatically unless you take out a subscription; no costs arise without your active order.

Payment is made monthly in advance via our payment provider Stripe, by card, TWINT, Apple Pay or Google Pay (depending on availability). By subscribing you authorise us to charge the amount automatically every month to the chosen payment method until you cancel.

If a payment fails, Stripe retries it. If the amount is not paid 7 days after the end of the paid period, access to the app is locked until payment is made.

5. Term and cancellation by you

Before starting we hold a short introductory call with every new client. We offer: (a) 12-week program, paid once: 12 weeks of access from payment; it does not renew automatically and does not need to be cancelled; an extension continues seamlessly. (b) 12-week program in instalments: 3 monthly instalments collected automatically; it ends automatically after the third. The instalments are owed for the whole program and cannot be cancelled early, subject to section 6. (c) Continued coaching after a program (monthly subscription): The subscription runs for one month at a time and renews automatically for another month unless you cancel.

You can cancel the monthly subscription at any time effective at the end of the current paid period, in the app under Settings → Subscription → “Cancel subscription” or by email to team@a-squared.ch. You receive a confirmation by email. You can keep using the app until the end of the paid period; access is locked afterwards. Paid periods are not refunded pro rata, except under section 6 or 9.

6. Money-back guarantee and right of withdrawal

If you cancel within 14 days of your first payment and request a refund by email to team@a-squared.ch, we refund your first payment in full, no reasons needed. The same applies to the 12-week program within 14 days of the (first) payment; with instalments, no further instalments are then collected. Access then ends immediately.

Consumers residing in the EU additionally have the statutory right of withdrawal of 14 days from conclusion of the contract. The money-back guarantee puts you in at least as good a position as this right. Mandatory statutory rights remain unaffected.

7. Price changes

We may adjust prices for future periods. We inform you by email at least 30 days in advance. If you do not agree, you can cancel before the change takes effect; otherwise the new price applies from the next period.

8. Health and personal responsibility

The coaching is not medical, physiotherapeutic, psychological or dietary therapy advice or treatment and does not replace it. We do not make diagnoses.

Get medical clearance before starting if you have pre-existing conditions (e.g. cardiovascular, high blood pressure, diabetes), injuries, pain or complaints, take medication, are pregnant or have recently given birth, or if you are unsure whether training and changing your diet are suitable for you. The coaching is not suitable for people with an eating disorder.

You train at your own risk. Use proper technique, warm up and choose weights you can handle safely. Stop training immediately in case of pain, dizziness, shortness of breath or other warning signs and seek medical help if needed.

You must inform us truthfully and completely about health limitations and tell us about changes.

9. Termination by us, end of beta

We may cancel the subscription effective at the end of a paid period. For good cause (e.g. misuse, abusive behaviour, false information) we may terminate the contract immediately.

If we discontinue the beta or the app entirely, we inform you at least 30 days in advance and refund paid, unused periods pro rata.

10. Your obligations

Keep your login details secret and do not share your access. Do not provide false information, upload unlawful content or misuse the app (e.g. attacks, automated scraping).

11. Intellectual property

The app, training plans, texts, videos and other content belong to us or our licensors. You may use them for personal use during the term. Sharing, publishing or commercial use is not permitted. Your own data and photos remain yours.

12. Liability

We are liable for damage caused intentionally or through gross negligence and under mandatory statutory provisions. Any further liability, in particular for slight negligence, indirect damage, lost profit, data loss, damage from interruptions or errors of the beta app, from inaccurate AI estimates, and for injuries and health consequences resulting from not following section 8, is excluded to the extent permitted by law. Where our liability cannot be excluded and to the extent permitted by law, it is limited to the amounts you paid in the last 12 months.

We are not liable for services of third parties (e.g. Stripe, Apple, Google, gyms).

13. Data protection

How we process your data is set out in the privacy policy, which forms part of this contract.

14. Changes to these Terms

We may change these Terms with effect for the future. We inform you of material changes in the app or by email. The new version applies once you accept it in the app; if you do not accept, you can cancel.

15. Applicable law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Bülach (Canton of Zurich). Mandatory places of jurisdiction and consumer protection rules, including those of the consumer’s country of residence, remain reserved.

Should any provision be invalid, the rest of these Terms remains valid.
